Face masks to be SIRIM-certified under Trade Descriptions Act 2011, takes effect on July 4

KUCHING, April 5: The Non-Medical Face Mask Trade Description (Certification and Marking) Order 2022 [Perintah Perihal Dagangan (Perakuan dan Penandaan) Pelitup Muka Bukan Perubatan 2022] has been gazetted under the Trade Descriptions Act 2011 today (April 5) and will take effect on July 4, 2022.

According to the Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) in a press statement issued today, this ensures that non-medical face masks that are manufactured locally and imported comply with the safety standards set.

“Manufacturers and importers of non-medical face masks must apply for SIRIM certification and marking from SIRIM QAS International Sdn Bhd as the competent authority appointed by KPDNHEP.

“The SIRIM marking must be placed on the packaging so that it is easily visible to consumers,” it said in the press statement.

It explained that the ministry would take enforcement action in the event of non-compliance by manufacturers and importers.

“For companies, a fine not exceeding RM200,000 will be issued, and for the second or subsequent offence, a fine not exceeding RM500,000 will be issued.

“As for individuals, a fine not exceeding RM100,000 will be issued or imprisonment for a term not exceeding three years, or both. For the second or subsequent offence, they will be issued a fine not exceeding RM250,000 or imprisonment not exceeding five years, or both.” — DayakDaily
