KPDNHEP advises e-cig manufacturers and importers to obtain SIRIM certification

KUCHING, April 5: The Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) encourages manufacturers and importers of electronic cigarettes to obtain SIRIM certification and labelling from SIRIM QAS International Sdn Bhd, the competent authority designated by KPDNHEP for user safety.

According to a press release issued by KPDNHEP today, the Trade Descriptions (Certification and Marking) of Electronic Cigarette Devices (vape device) Order 2022 was gazetted on April 5, 2022 under the Trade Descriptions Act 2011.

ā€œThe goal of the gazette is to ensure that electronic cigarette devices manufactured or imported meet the safety standards outlined in this order.


ā€œThe MS SIRIM label must be visible to the user on the electronic cigarette device, its spare part, or the container of the supplied device.

ā€œThe MS SIRIM label on electronic cigarettes indicates that they have met all applicable standards and are safe to use,ā€ KPDNHEP stated in its statement.

It went on to say that the Ministry can take enforcement action if manufacturers and importers do not comply.

ā€œCompanies will be fined up to RM200,000.00 for the first offence, and up to RM500,000.00 for the second or subsequent offence.

ā€œMeanwhile, individuals will face a maximum fine of RM 100,000.00 or a maximum sentence of 3 years in prison, or both, for the first offence, and a maximum fine of RM 250,000.00 or a maximum sentence of 5 years in prison, or both, for the second or subsequent offence,ā€ the ministry said.

KPDNHEP also stated that the gazetting is a government initiative concerned with the spirit of the Malaysian Family (Keluarga Malaysia) in order to protect the well-being of the people and the interests of consumers.

Furthermore, the Ministry hopes that the issue of dumping of low-quality electronic cigarette devices in the Malaysian market will be resolved by manufacturers and importers adhering to the set standards. ā€” DayakDaily
