38yo man acquitted of extortion, wrongful confinement charges after police report retracted

KUCHING, Nov 2: The Magistrates’ Court here today discharged and acquitted a man faced with two charges of extortion and wrongful confinement.

The Magistrate Puan Syarifah Fatimah Azura Wan Ali ordered that the 38-year-old accused be discharged and acquitted after the complainant and the victim both withdrew their police report against the accused.

Both parties also testified in Court that their withdrawal of the report was voluntary and that they understood the implications of such action.


Additionally, the Magistrates’ Court also found that the two charges lacked merit, given the express disinterest of both the complainant and the victim in pursuing the case further.

The case was prosecuted by Inspector Ammarsoffi Yusoff, while the accused was represented by Counsel Shankar Ram, Yu Ying Ying and Russell Lim.

According to the brief facts of the case, the accused allegedly engaged in extortion on March 21, 2022, inducing fear of harm upon the victim.

Furthermore, between March 21 to 27, 2022, the accused was purportedly involved in wrongfully restraining and confining the victim for more than three days.

The first charge, pertaining to extortion, was framed under Section 384 of the Penal Code and carries a punishment of imprisonment which may extend to ten years or with fine or with whipping or with any two of such punishments upon conviction.

The second charge, concerning wrongful confinement, was framed under Section 343 of the Penal Code and carries a punishment of imprisonment of up to two years or with fine or with both upon conviction. — DayakDaily
