3 underaged rape cases, 3 pregnancies, 3 convictions

KUCHING, July 14: Three different men were convicted at the Sessions Court here today in three separate cases for raping their underage girlfriends.

They were all charged under Section 376(1) of the Penal Code which carries a maximum imprisonment term of 20 years and liable to whipping upon conviction.

Dovian Smift Tony, 20, was charged with committing rape on his girlfriend who was 15-years-old, at his house in Taman Riverview in April 2019. As a result, the victim became pregnant and the baby’s DNA matched his.


He pleaded guilty to the charge. Sessions Court Judge Jason Juga sentenced him to nine years’ imprisonment with effect from today and to two strokes of the rotan.

The court also ordered the accused to undergo rehabilitative counselling and police supervision as provided under Sections 26 and 27 of the Sexual Offences Against Children Act.

In an unrelated case, Indonesian Warsito Munaji, 30, a construction worker was charged with raping his 15-year-old girlfriend at a worker’s quarters in Taman Zorian on October 2019.

The victim underwent a checkup at the Maternity and Pediatric Clinic in Gita where it discovered by a doctor that she was pregnant. The doctor then lodged a police report.

Warsito pleaded guilty to the charge and was sentenced to nine years’ imprisonment and two strokes of the rotan.

Sessions Court Judge Jason Juga also ordered the accused to be deported to Indonesia after he served his sentence here as the accused does not have a valid pass to enter Sarawak.

In the same courtroom, a 17-year-old offender was ordered to be sent to the Henry Gurney School under he reaches the age of 21 for raping his underage girlfriend at the victim’s friend’s house in Jalan Astana.

The victim became pregnant and the baby’s DNA matched with the accused’s.

DPP Nurfadzlin Mahmad Zulhasnan prosecuted all the three cases while and all the accused were unrepresented by counsel. — DayakDaily
