Two Puncak Borneo inmates get 7 more months in jail for assault over unpaid cigarette debt

KUCHING, April 1: Two inmates were sentenced to seven months in prison by the Magistrates Court here today for injuring a fellow inmate over an unsettled cigarette debt.

Muhamad Firdaus Roslan, 32, and Mohd Nor Affizzull Mahdi, 29, pleaded guilty upon being charged under Section 323 of the Penal Code read together with Section 34 of the same code.


The section provides for a jail term of up to one year or a fine of up to RM2,000, or both, upon conviction.

They were charged with intentionally causing harm to Mohd Azril Nahar, 41, around 10.30pm on the third-floor of the men’s dormitory at Puncak Borneo Prison here on March 8, 2024.

Based on the case facts, both accused assaulted the victim on his face, head, and body using their hands due to failure to settle a debt after purchasing cigarettes from Muhamad Firdaus, with the debt doubled if not paid promptly.

Furthermore, the two accused were reported to have stabbed the victim’s abdomen once using a makeshift lamp lighter.

As a result of the incident, the victim suffered injuries requiring treatment at the Emergency Unit of Sarawak General Hospital (HUS).

The victim lodged a police report, leading to the arrest of the two accused on March 11, 2024.

Investigations revealed injuries to the victim’s face, behind the ear, and back of the head, as confirmed by medical reports from HUS.

Magistrate Syarifah Fatimah Azura Wan Ali ordered the prison sentences for both accused to be enforced after they completed their current jail terms.

It is understood that Mohd Nor Affizzull was previously convicted of robbery while Firdaus was said to be involved in a drug case.

Prosecution was conducted by Inspector Ammarsoffi Yusoff, while the two inmates were not represented by legal counsel. — DayakDaily
