KUCHING, March 12: A company director was fined RM3,000 or sentenced to three months’ imprisonment by the Sessions Court today after pleading guilty to possessing communication equipment without certification from the Malaysian Communications and Multimedia Commission (MCMC) with the intent to sell.
Judge Afidah Abdul Rahman handed down the sentence to Ting Leong Hieng, 49, after he admitted to the offense under Regulation 16(1)(b) of the Communications and Multimedia (Technical Standards) Regulations 2000, read together with Section 244(1)(a) of the Communications and Multimedia Act 1998. The offence is punishable under Regulation 16(3) of the same regulations.
According to the charge, Ting was found in possession of three units of Keruier Model KH-Q7 walkie-talkies without the required certification, intending to sell them. The offense was committed on October 11, 2023, at around 11.20am at a shopping mall along Jalan Stutong, Kuching.
In a related case, a company owned by Ting was also fined RM5,000 after he, as its director, pleaded guilty to the same offence involving the possession of the uncertified walkie-talkies at the same location and time. If the fine is not paid, a warrant of levy would be issued against the company.
Before sentencing, Ting pleaded for a lighter punishment, stating that this was his first offence and that he was unaware that selling walkie-talkies required certification.
He explained that he had purchased the devices from an online platform before reselling them, only realising that it was an offence after being questioned by MCMC officers. Upon learning of the violation, he immediately ceased selling the devices and requested leniency from the court.
However, MCMC prosecuting officer Siti Hajar Sulaiman argued that an appropriate sentence was necessary to serve as a deterrent against similar offenses in the future.
Ting was not represented by a lawyer during the proceedings. – DayakDaily
