Policeman escapes death sentence after chemist report proves no drugs found in luggage during airport arrest

KUCHING, Feb 8: A police officer escaped the gallows after it was proven that he was not carrying drugs during his initial arrest.

The chemist report proved that the substance suspected to be drugs that was found in his luggage had no dangerous drug content after he was arrested for allegedly trafficking 5.6kg of cannabis at the arrival hall of Kuching International Airport, at about 10.10pm on Jan 2, 2023.


Aizat Danial Noor Azman, 30, was initially detained under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a death sentence or imprisonment for life and with whipping of not less than 15 strokes, upon conviction.

Aizat was arrested by Customs officers at the Special Passenger Inspection Unit after his check-in luggage and backpack were suspected to be carrying 20 bottles filled with substances suspected to be a mixture of juice and cannabis, with a gross weight of 5.6kg.

According to the chemist report tendered by the prosecution before Magistrate Syarifah Fatimah Azura Wan Ali, it was found that the bottles that were confiscated by the Customs officer had no drug content.

Therefore, the prosecution withdrew that case against Aizat as there were no elements to charge him under Section 39B(1)(a) of the Dangerous Drugs Act 1952.

Magistrate Syarifah then discharged and acquitted Aizat of the charge.
