Neighbours ordered to maintain peace following fight over homeless man’s posessions

KUCHING, March 18: Two local men residing in close proximity have been instructed to post bonds to ensure peace for six months by the Magistrate’s Court here after getting into a scuffle over relocating a homeless man’s belongings.

Tan Kuok Chung, 48, and Mohd Nezzary Abdullah, 52, each pleaded guilty to one charge under Section 67 of the Criminal Procedure Code.


According to the case facts, on Feb 29 around 11pm, Tan (the complainant) reported to the police that when he arrived to visit his parents’ home on Ellis Road, he was approached by four unidentified men who assaulted him.

As a result of the incident, he suffered injuries to his right rib.

However, police investigations revealed that the altercation stemmed from a previous dispute when the complainant entered an empty house and moved a box belonging to a homeless man known as Alobo.

Prior to the altercation, the homeless man sought help from Nezzary to safeguard the box.

Subsequently, an argument ensued due to provocation from Tan towards Nezzary, leading to a scuffle resulting in mutual physical altercations.

It was stated that the complainant had known Nezzary for a long time as they had been residing in the same neighbourhood for quite some time.

Therefore, as a preventive measure against recurring incidents, Magistrate Mason Jaro Lenya Barayan ordered both of them to post bonds to maintain peace for six months with a guarantee of RM500 each along with a local surety.

The prosecution was handled by Inspector Merylene Lindan Andrew Mang, while the defendants were not represented by legal counsel. — DayakDaily
