KUCHING, July 18: A 58-year-old man was fined RM1,500 or in default three months imprisonment by the Magistrate’s Court today for threatening to kill his brother over durian.
Alek Dawi pleaded guilty before Magistrate Mason Jaro Lenya Barayan after being charged under Section 506 of the Penal Code, which carries a penalty of up to seven years imprisonment, a fine, or both.
According to the charge, the offense was committed on Sept 7, 2023, at around 4.30am in an orchard at Kampung Pesa, Jalan Mambong, Padawan.
The brief facts of the case revealed that the complainant, the 56-year-old brother of the accused, was collecting durians in the orchard when the accused arrived to collect durians as well. The complainant informed the accused that the durians were for sale.
Dissatisfied with this, the accused got into his car and took out a machete.
He also threatened to shoot the complainant with a shotgun and chased him to a hut, damaging the complainant’s motorcycle in the process.
Fearing for his safety, the complainant lodged a police report, leading to the arrest of the accused on Sept 9, 2023.
Additionally, on Sept 29, 2023, the accused was also fined RM1,500 or three months imprisonment by the same court for damaging the seat of the complainant’s motorcycle.
For this offense, he was charged under Section 427 of the Penal Code, which carries a penalty of up to five years imprisonment, a fine, or both upon conviction.
The accused was not represented by a lawyer, while the prosecution was handled by Prosecuting Officer Inspector Merylene Lindan Andrew Mang. — DayakDaily
