KUCHING, Oct 15: A 48-year-old mechanic was sentenced to a RM4,000 fine or seven months’ jail by the Magistrates’ Court after pleading guilty to possessing and distributing explicit videos of his wife on Facebook.
The accused admitted to the charges before Magistrate Ling Hui Chuan. The accused was charged under Section 292 of the Penal Code, which deals with the distribution and possession of obscene material. The charge carries a maximum penalty of three years imprisonment, a fine, or both.
The charges stemmed from an incident on May 16, 2024, at a house in Kampung Tapah, along Jalan Kuching-Serian, where the accused was found in possession of explicit videos on his phone.
The case facts revealed that the accused’s wife, a 41-year-old Indonesian woman, was informed by a friend that her husband had uploaded inappropriate videos and images of her on Facebook. The videos, taken without her knowledge, showed her undressing in the bathroom, while the images depicted her in a partially nude state.
The victim, feeling deeply humiliated and traumatised by the public exposure, reported the matter to the police. She suspected her husband had stored several other compromising images and videos of her.
Upon receiving the report, authorities arrested the accused on May 16 and seized his phone. Investigators found a nude video stored in his device.
During the court hearing, the accused claimed he recorded the videos as “evidence” in case his wife acted improperly. Magistrate Ling, however, admonished him, stating that even if there were marital issues, it was inappropriate to handle the situation in such an extreme manner.
The prosecution was handled by Inspector Nur Shafiqa Nyaie Ilin, while the accused appeared in court without legal representation. — DayakDaily
