KUCHING, March 30: The Magistrate’s Court here discharged and acquitted a 61-year-old man over a charge of criminal intimidation of his son-in-law after the son-in-law had allegedly hurt her daughter.

Magistrate Zaiton Anuar today ruled that the prosecution had failed to prove a prima facie case against the accused Tang Chek Nan and therefore discharged and acquitted him without calling for his defence.

Among the elements that the prosecution had failed to prove were that Tang had threatened the complainant and the weapon allegedly used by the accused was not found.

The accused was charged with committing criminal intimidation by threatening to cause death to his son-in-law, 51, in front of a shop lot in Jalan Setia Raja, at about 1pm on May 15, 2021.

He was charged under Section 506 of the Penal Code which carries imprisonment up to two years or with fine, or both, upon conviction.

According to the brief facts of the case, the accused had allegedly went to the complainant’s office with a knife after the accused learned that the complainant had allegedly hurt the accused’s daughter who is also the complainant’s wife, where the accused allegedly threatened to kill the complainant.

The son-in-law then lodged a police report for his own safety.
