Unemployed man jailed 14 months for threatening, spitting at elderly mother over money demand

KUCHING, May 7: An unemployed man who repeatedly spat at his elderly mother and threatened to assault her after she refused to give him money was sentenced to 14 months’ jail by the Magistrate’s Court here today.

The 36-year-old man pleaded guilty to two charges before Magistrate Ling Hui Chuan without legal representation.

For the first charge under Section 506 of the Penal Code for criminal intimidation against his 68-year-old mother, the court sentenced him to 14 months in prison.

He was also sentenced to three months’ jail under Section 509 of the Penal Code for insulting the modesty of the victim by spitting in her face.

However, the court ordered both sentences to run concurrently from April 7, 2026, the date of his arrest.

According to the charges, the offences were committed at about 9.30pm on April 2, 2026, at a house in Kampung Sungai Apong Baru.

Facts of the case revealed that the accused became aggressive during an argument with his mother, repeatedly spitting in her face while punching the wall and the mattress where she had been lying.

The court heard that similar incidents had occurred frequently, leaving the victim fearful and traumatised as the accused would often lose his temper whenever his demands were not met or when he was denied money.

During the incident, he also threatened the victim by saying “watch out later”, intending to instil fear of harm. The accused later demanded his mother’s mobile phone before leaving the house.

Investigations revealed that he was under the influence of drugs during the incident and had allegedly been demanding money from his mother to buy drugs.
Fearing for her safety, the victim lodged a police report, leading to the accused’s arrest on April 3, 2026.
