KUCHING, Oct 7: A 45-year-old man was fined RM6,000 by the Magistrate’s Court today after he pleaded guilty to causing the death of a 33-year-old woman in a negligent driving incident five years ago.
Magistrate Ling Hui Chuan also ordered him to serve three months in jail if he failed to pay the fine.
The court heard that the accused was driving a Toyota Caldina MPV along Jalan Batu Kawa, Sungai Moyan, Bau, at about 11.30am on Aug 31, 2021, when he lost control of the vehicle and crashed into the rear of a Perodua Kenari travelling ahead.
The impact sent the Kenari into a concrete road divider, causing it to overturn and throwing its driver from the vehicle.
She suffered severe head injuries and was pronounced dead at the scene.
The accused, meanwhile, escaped unhurt.
Police were alerted to the fatal crash involving the two vehicles at the junction, with the accused later lodging the police report himself.
Investigations found that the crash was caused by his failure to drive with due care and consideration for other road users.
He was charged under Section 43(1) of the Road Transport Act 1987, which carries a fine of between RM5,000 and RM10,000, or imprisonment of up to 12 months, or both. The section also requires particulars of the conviction to be endorsed on the offender’s driving licence.
The court ordered that the conviction be endorsed on the accused’s licence.
