KUCHING, Nov 2: A man was sentenced to eight years in prison and three strokes of the cane by the Sessions Court here today for striking his uncle with a parang and slapping his mother.
Judge Afidah Abdul Rahman handed down the sentence to Mohammad Sahnizam Musa, 27, after he pleaded guilty to two charges against him read by the court interpreter.
Afidah ordered the accused to serve an eight-year prison term and three strokes of the cane for the first charge, while for the second charge, he was sentenced to one year in prison. Both prison sentences are to run concurrently from the date of the accused’s arrest.
The accused was charged under Section 326 of the Penal Code read together with Section 326A of the same Code, for intentionally caused grievous bodily harm to his 43-year-old uncle using a parang.
The second charge under per Section 323 of the Penal Code read together with Section 326A of the Penal Code was for causing hurt to his 63-year-old mother by slapping her in the face.
Both offenses were committed on August 26, 2023, at around 3.30am at the family residence in Kampung Tabuan Hilir.
According to the case’s facts, the complainant, who is the accused’s sister, was sleeping in an upstairs room of the house before she was awakened by a knock on the door. She came out of her room and found her uncle who informed her that the accused had attacked the uncle with a parang while he was sleeping in the living room on the ground floor of the house.
Upon witnessing this, the complainant reviewed the home’s closed-circuit television (CCTV) footage and discovered that the accused had struck the victim’s head with a parang.
As a result of the incident, the uncle suffered severe injuries, including wounds to the back of the head and face. During the incident, the accused’s mother attempted to prevent the accused from attacking the victim, but he slapped her in the face.
Concerned for the safety of herself and her family, the complainant filed a police report, leading to the accused’s arrest on the same day. The motive for the incident remains unknown.
