KUCHING, Dec 10: A 29-year-old man was today fined RM2,000 by the Magistrate’s Court for possessing ketamine.
Tsok Kian Tak from Jalan Lapangan Terbang was initially charged under Section 39B(1)(a) and punishable under Section 39B(2) of the Dangerous Drugs Act 1953, which carries the mandatory death sentence, for trafficking 303.64 grammes of 3,4 Methylenedioxymethamphetamine.
But a drug chemist report done by the Chemistry Department showed that the drugs seized earlier were actually 13.3 grammes of Ketamine.
Hence, the initial charge against the accused was amended to an offence under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 12(3) of the same Act for possessing 13.3 grammes of Ketamine on Oct 30, 2018, at about 11.30am at Jalan Lapangan Terbang.
