KUCHING, Feb 11: A former watchman of Bau District Health Department who was sentenced last year to 15 years behind bars plus 3 strokes of the rotan for touching and sucking his 10-year-old foster daughter’s breast now has to stay much longer in prison and undergo more whipping.
The accused, 50, was brought to the Sessions Court here today to face a charge for raping and physical sexual assault of the 10-year-old.
When he pleaded guilty to the charge, Sessions Court judge Mohd Taufik Mohd Yusoff sentenced him to 20 years in jail plus 10 strokes of the rotan. Mohd Taufik ordered that the imprisonment term run consecutively with his current sentence.
This means Hamzah, who is also the victim’s brother-in-law, has to stay in jail for 35 years and be given 13 strokes of the rotan.
He was today charged under Section 376(2)(e) of the Penal Code for raping his foster daughter between Jan 2017 and Dec 2017 at a house in Bau. Section 376(2)(e) of the Penal Code carries imprisonment of not less than 10 years and not more than 30 years and whipping.
For the other charge in 2018, he was sentenced to 15 years behind bars and 3 strokes of rotan for touching and sucking the victim’s breast in 2018 in the guard room of the Bau Health Department’s office.
For this offence, he was charged under subsection 14(a) of the Sexual Offences Against Children Act 2017 and punishable under Section 14 of the same Act, which carries imprisonment not exceeding 20 years and whipping.
DPP Syarifah Fatimah Azura Wan Ali prosecuted the case today, while the accused was not represented. — DayakDaily
