KUCHING, July 20: A construction worker was acquitted of raping an underage girl by the  Sessions Court here today.

Sessions Court judge Marutin Pagan made the ruling at the end of the prosecution’s case after the prosecution failed to establish a prima facie case against the accused.

Satop Munib allegedly raped the 14-year-old victim between May and October 2016 at the shop of the accused’s wife at Kampung Karu.

The victim was then pregnant and a baby girl was born.

He was charged under Section 376(2)(d) of the Penal Code, which carries imprisonment between 10 years and 30 years and liable to whipping, upon conviction.

The Court ruled that that the prosecution had failed to prove that the accused is the biological father of the victim’s baby.
