27yo woman gets 50 months’ jail for motorcycle theft, drug offenses

KUCHING, Sept 2: A 27-year-old woman was sentenced to 50 months in prison by the Magistrate’s Court today after pleading guilty to charges of motorcycle theft, drug possession, and drug abuse.

The accused, Nur Athirah Mohamad, faced charges under Section 379A of the Penal Code, read together with Section 34 of the same Code, for stealing a motorcycle.

In addition to the theft charges, she was also charged under Section 12(2) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39(1) of the same Act, as well as Section 15(1)(a) of the DDA 1952, for drug possession and abuse.

Magistrate Ling Hui Chuan sentenced Nur Athirah to 15 months in prison for the motorcycle theft.

For the drug-related offenses, Ling ordered Nur Athirah to serve 30 months and 5 months for possession and drug abuse, respectively.

All sentences are to run concurrently.

In addition to Nur Athirah, her acquaintance, 29-year-old Mohd Khairul Abdullah, was also sentenced to 15 months in prison for his involvement in the motorcycle theft.

The duo was charged with committing the offense on Aug 27, 2024, at approximately 8.29am, on the sidewalk in front of a shop on Jalan Abell here.

The case details revealed that a 25-year-old man reported to the police that his motorcycle, which had been parked on the sidewalk in front of the shop, was stolen. The estimated loss was valued at RM11,000.

Police investigations led to the arrest of both accused. Further investigation confirmed that the motorcycle seized from them matched the one reported stolen, based on the engine and chassis numbers. Additionally, CCTV footage from the scene captured images of the two accused stealing the complainant’s motorcycle.

In a separate charge for drug possession, Nur Athirah was accused of possessing 17.21 grammes of methamphetamine at a flat in Roban, Jalan Ban Hock, on Sept 30, 2022.

During a police search, a transparent plastic packet containing crystal-like substances suspected to be drugs was found in her bag.

Nur Athirah was subsequently arrested and subjected to a urine test, which confirmed she was positive for drug use.

The prosecution was led by Inspector Nur Shafiqa Nyaie Ilin, while Nur Athirah was not represented by a lawyer. — DayakDaily
