Youth gets 12 years’ jail, 5 rotan strokes for violent assault on father

KUCHING, Feb 15: The Sessions Court here sentenced a youth to 12 years in jail and 5 strokes of the cane for voluntarily causing hurt to his father because his father failed to give him cigarettes.

The 20-year-old accused pleaded guilty to the charge framed under Section 326 of the Penal Code and read together with Section 326A of the same Code, which carries a maximum term of 20 years’ imprisonment, and with fine, or with whipping, upon conviction.


Sessions Court Judge Musli Ab Hamid sentenced the accused to 12 years’ imprisonment and 5 strokes of the cane after going through the facts of the case, the exhibits, the accused’s mitigation and social report from the Welfare Department.

The judge ordered the imprisonment term to start from the date of arrest, January 7, 2023.

The accused was charged with voluntarily causing hurt to his 58-year-old father using a helmet and a rotan, at a house in Petra Jaya, at about 6.28pm on January 7, 2023.

According to the brief facts of the case, the accused’s brother-in-law lodged a police report after learning that the accused had hurt the victim by using two objects. The accused was arrested by the police on the same date at about 7.50pm.

The police investigation revealed that the accused acted aggressively towards his father because his father refused to give him cigarettes when requested by the accused.

The victim suffered several fractures to his face and bruises to his left eye.

Deputy Public Prosecutor Norshafatihah Nor Azmi prosecuted while the accused was unrepresented by counsel. — DayakDaily
