Maximum jail time for parents who abused 5-year-old son

KUCHING, Sept 3: The Magistrate’s Court here sentenced a couple to 12 months’ imprisonment each for abusing their 5-year-old son.

The couple, both aged 24, pleaded guilty before Magistrate Mohd Syukri Mokhtar.


They shed tears after the sentence was meted out by Mohd Syukri.

They were charged with voluntarily caused hurt to their eldest son at their house in Jalan Kulas Barat, at about 12 pm on July 18, 2020.

They were charged under Section 323 of the Penal Code and read together with Section 326A of the same Code, which carries an imprisonment term of a maximum of one year or with a maximum fine of RM2,000, or with both, upon conviction.

The police investigation revealed the abuse incident was caused by the mother of the victim who was angry because the victim had disobeyed his mother’s directive not to play with pipe water.

According to the facts of the case, a medical officer at Sarawak General Hospital children’s ward subsequently lodged a police report after finding scratch marks on the victim’s forehead, bruises at the corner of his left eye, a wound behind his head and swelling on his left ring finger.

She suspected the child was abused and lodged a police report for the police to take further action.
