Man who injured father gets 5 years’ jail, three rotan strokes

KUCHING, Dec 23: A self-employed man was sentenced to a jail term of five years and three strokes of the cane after he was found guilty of voluntarily causing hurt to his father with a wooden stick and piece of steel.

Sessions Court Judge Dayang Ellyn Narisa Abang Ahmad convicted Philip Najep, 41, after a full trial.

The judge sentenced the accused to imprisonment of five years with effect from the date of his arrest, January 11, 2020 and three strokes of the cane.

Philip was charged with hurting his 74-year-old father with a wooden stick and piece of steel at their house in Kampung Serumah Gayu, Jalan Padawan, at about 4pm on January 10, 2020.

He was charged under Section 326 of the Penal Code read together with Section 326A of the same code, which carries a maximum imprisonment term of twenty years and with fine or with caning, upon conviction.

According to the brief facts of the case, the accused was drunk at the time. Conflict arose between the accused and his father and the accused subsequently caused hurt to his father by using a wooden stick and piece of steel.

The victim suffered injury on his left arm bone, forehead and left leg.
