SIBU, Dec 16: The Sessions Court today sentenced a 25-year-old man to 12 years jail today for raping an underaged intellectually disabled girl.
Justice Caroline Bee Majanil also ordered that the accused, Kong Ming Hua be whipped with two strokes of the rotan.
His 14-years brother who was also charged with the same offence was released on a bail of RM4,000 in one surety by the Juvenile Court while awaiting for the welfare department probation report.
Ming Hua, 25, and his 14-year-old brother were both charged under Section 376 (2) of the Penal Code for the offence which was committed in June this year in Stabau near here.
The offence provides for an imprisonment term of not less than 10 years and not more than 30 years and whipping.
According to the facts of the case, Ming Hua had raped the 16-year old girl at her house while his brother raped her on the same day at a place near the river which was not far from her house.
The accused persons and the victim are neighbours.
The elder brother was arrested on Dec 10 at their family’s home in Stabau Road.
His brother was detained on the same day at Kampung Nyabor Road.
The victim who was brought for a medical check-up by her aunt on Dec 5 to a clinic in Salim Road was found to be six months pregnant. – DayakDaily
