Man gets jail and caning, while girlfriend gets jail for drug possession

KUCHING, Feb 22: A 34-year-old man was yesterday sentenced to a total of 9 years and six months in jail and 10 strokes of the rotan, while his 22-year-old girlfriend was given a six-month jail sentence for drug possessions.

High Court judge Azhahari Kamal Ramli meted out the sentence after both first accused Mohamad Zulizan Affendi and second accused Lim Seng Sia pleaded guilty to the alternative charges framed against them.


Azhahari sentenced Mohamad to eight years imprisonment and 10 strokes of the rotan for the first alternative charge, and 9 months jail each for the second and third alternative charges.

He ordered the imprisonment term to run concurrently from the day Mohamad was arrested. This means the first accused has to serve 8 years in jail and be whipped 10 times.

For the first alternative charge under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 39A(2) of the same Act, Mohamad was found to be in possession of 64.44 grams of Methamphetamine at a hotel room on May 11, 2018, at about 1pm. The penalty upon conviction is a jail term of not less than 5 years and not less than 10 strokes of the rotan.

As for the second and third alternative charges under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Subsection 12(3) of the same Act, Mohamad pleaded guilty to possessing 30.68 grams of Ketamine and 1.31 grams of MDMA at a hotel room on May 11, 2018, at about 1pm.

He may be fined not exceeding RM100,000 or be imprisoned for a term not exceeding 5 years or both under this section of the Act.

Lim, on the other hand, was sentenced to 6 months imprisonment, also from the date of her arrest.

She was charged under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Subsection 12(3) of the same Act for possessing 0.29 grams of Methamphetamine at a hotel room on May 11, 2018, at about 1pm.

DPP Musli Abdul Hamid prosecuted, while the first accused was represented by counsels Roger Chin and Osman Ibrahim and the second accused by counsel Wong King Wei. — DayakDaily
