KUCHING, Feb 22: A construction worker was today sentenced to a total of 14 years’ jail plus two strokes of the rotan for raping his underage girlfriend.
Sessions Court judge Jason Juga meted out the sentence after Miton Wing, 23, from Engkilili pleaded guilty to two rape charges.
For each charge, he was slapped with 7 years’ imprisonment and 1 stroke of the rotan, and Jason ordered that the jail terms to run concurrently.
In his mitigation, Miton, said he and his 13-year-old girlfriend loved each other and that he had promised to marry her.
But DPP Syarifah Fatimah Azura Wan Ali requested the court to impose a deterrent sentence considering the nature of the offence, where the victim was still not in a mind to decide for herself.
The accused was charged with raping the girl inside a room of a house at Kampung Keranji on Feb 8 at about 9pm and again on Feb 9 at about 9pm.
He was charged under Section 376(1) of the Penal Code, which carries imprisonment that may extend to 20 years and shall be liable to whipping.
