Man convicted of raping granddaughter appeals against sentence

KUCHING, June 25: A man who was convicted of raping his own granddaughter, committing intercourse against the order of nature and physical sexual assault appealed against the sentence of 70 years in jail and 20 strokes of the cane.

The 67-year-old appellant was charged and convicted of five charges in 2019 where he was sentenced to total imprisonment of 70 years and 20 strokes of the cane.

Kuching High Court Judge Christopher Chin Soo Yin fixed July 27 for mention of the case as the case was heard in Kota Samarahan Sessions Court. The prosecution has yet to receive the note of proceeding of the case.


He was charged with three charges for raping his granddaughter who was then 11-years, 3 months old at their house in Kota Samarahan between January 2018 and June 2018.

He was charged under Section 376(2)(e) of the Penal Code for these acts and was sentenced to imprisonment of 15 years and four strokes of the cane for each charge.

He was also convicted under Section 377C of the Penal Code for intercourse against the order of nature on June 21, 2018. He was sentenced to imprisonment of 15 years and four strokes of the cane under this section.

He was also convicted under subsection 14(a) of the Sexual Offences Against Children Act 2017 for physically sexually assaulting his granddaughter on June 21, 2018. He was sentenced to imprisonment of 10 years and four strokes of the cane.

Sessions Court Judge Afidah Abdul Rahman convicted him on October 18, 2019 and ordered the sentences to run consecutively. He appealed against the sentence to Kuching High Court here today.—DayakDaily
