KUCHING, Feb 15: A 40-year-old man pleaded not guilty at the Sessions Court today to having sex with his 13-year-old daughter at a rented room early this month.
Sessions Court Judge Marutin Pagan ruled that since this is an incest case and both the accused and victim are living together, bail could not be granted.
Judge Marutin then fixed March 14 for pre-trial case management and trial to be on May 7 and 8, 2019.
Accused Ahmad Ruzaine Abdullah from Serian was charged under Section 376B(1) of the Penal Code for raping his 13-year-old daughter at their rented room located at Synergy Square in Matang Jaya on Feb 2 this year.
This section of the Code provides for imprisonment of not less than 10 years and not more than 30 years and liable to whipping.
Deputy Public Prosecutor Nor Azhari Yusof prosecuted while the accused was unrepresented. — DayakDaily
