Man acquitted of injuring another man with car

KUCHING, Aug 4: The Sessions Court here discharged and acquitted a man of a charge of voluntarily causing grievous hurt to his friend with a car.

Judge Dayang Ellyn Narisa Abang Ahmad found Ahmad Zaidi Adruce Jol@Julaihi not guilty of the charge framed under Section 326 of the Penal Code and therefore discharged and acquitted Ahmad Zaidi.

The judge ruled the accused through his counsels Shankar Ram Asnani, Yu Ying Ying and Russell Lim has succeeded in establishing the defence of accident on a balance of probabilities.

The Court also found that the investigation conducted by the investigating officer was shoddy and that the evidence given by the accused was corroborated by the accused’s own witnesses as well as the prosecution’s witnesses.

During the examination earlier, when being asked why he did not stop his car after knocking someone down, the accused clarified he was unaware that he had knocked the victim down and he thought that the person knocked down was on the other side and wanted to head to the police station. This testimony was unchallenged.

The accused was then pursued by the group who caught him at Jalan Samariang and was beaten violently and suffered a maxillary wall fracture.

The accused was charged with voluntarily causing grievous hurt to Mohamad Faizal Affandi by using a car at a car park in Bandar Baru Samariang, at about 9pm on June 12, 2020.
