KUCHING, Jan 30: A local man has been fined RM900 by the Magistrate’s Court for trespassing into the house of an elderly resident while intoxicated last Sunday.

Elexton Tony Peter, 26, pleaded guilty to the charge under Section 448 of the Penal Code before Magistrate Mason Jaro Lenya Barayan.

According to the charge, he was accused of intentionally breaking into the house of a 60-year-old man in Bandar Baru Samariang, Jalan Sultan Tengah, around 2.30am on Jan 28.

Based on the facts of the case, the complainant’s wife reported that someone had forcefully knocked on their front door and despite the door being locked, the accused allegedly managed to enter the victim’s house by forcefully pushing the door until the latch broke.

The complainant subsequently filed a police report for further action, leading to the arrest of the accused on the same day around 2.45am.

No items were reported missing from the house.

Further investigation revealed that the accused, soaked and smelling of sewage and alcohol, was found inside the victim’s house.

It was understood that the inebriated accused did not act aggressively; instead, he sat on the floor, pleading with the victim to contact the police and claiming no memory of the events.

The prosecution was led by Inspector Merylene Lindan Andrew Mang, while the accused was not represented by legal counsel. — DayakDaily
