KUCHING, Aug 25: The Sessions Court here sentenced a man to a total of 18 years in jail and ten strokes of the cane for incest rape and sexually assaulting his 12-year-old niece inside a car.
Sessions Court Judge Afidah Abdul Rahman sentenced the 44-year-old accused to a jail term of 18 years and seven strokes of the cane for the charge of incest rape and 8 years of imprisonment and three strokes of the cane for the charge of sexual assault.
The judge ordered the imprisonment terms to run concurrently and with effect from the date of arrest, which is August 17, 2021.
For the first charge, the accused was charged with committing incest rape on his niece inside a Proton Iswara Aeroback, at Kampung Keranji, at about 6.15pm on July 19, 2021.
He was charged under Section 376B(1) of the Penal Code, which carries imprisonment between 10 years and 30 years and is also liable to whipping.
As for the second charge, the accused was charged with kissing the victim’s cheek for sexual purposes, inside a Proton Iswara Aeroback, at Kampung Keranji, at about 6.15pm on July 19, 2021.
He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries imprisonment not exceeding 20 years and is also liable to whipping.
According to the facts of the case, on the day of the incident, the victim had gone out with the accused in a car to buy drinks.
However, the accused suddenly stopped his car at a quiet bush area and asked the victim to have sex with him.
The girl refused but the accused took out a folding knife and placed it on the victim’s neck and raped her.
The accused is the elder brother of the victim’s mother and they were staying in the same house.
Deputy Public Prosecutor Nadratum Naim Mohd Saidi prosecuted the case while the accused was unrepresented by counsel. — DayakDaily
