Indonesian involved in gang robbery to ‘pay for father’s medical bills’ gets 6 years in jail

KUCHING, May 25: The Sessions Court here has sentenced an Indonesian to a jail term of six years for possessing stolen properties, which he said were stolen to pay for his father’s medical bills after the latter contracted with lung cancer.

Sainal, 21, from Pontianak pleaded guilty to two charges framed under Section 412 of the Penal Code.


In the first charge, he was found possessing stolen properties, consisting of one unit of a Redmi Note 8 Pro belonging to Siaw Lee Ching, in the commission of a gang robbery, at Kampung Stass, at about 4.15 am on May 10, 2021.

For the second charge, he was found possessing stolen properties, which were a necklace and two units of rings belonging to Siaw Lee Ching, at IPD Bau, at about 11.20 am on May 14, 2021.

Both charges are framed under Section 412 of the Penal Code, which carries an imprisonment term which may extend to twenty years and a fine.

His gang members, Dandi Adytia Firhandha, 22, and Romi, 21 who had committed the gang robbery were sentenced to a jail term of eight years and four strokes of the cane.

Sainal in his mitigation in Court today said that he was forced to commit gang robbery to bear the cost of his father who had contracted lung cancer.

Deputy Public Prosecutor Ruthra Raj prosecuted while the accused was unrepresented by Counsel.
