KUCHING, Oct 25: A carpenter was sentenced to 12 years’ jail and 10 strokes of the cane for raping his biological daughter who was 12-years-old at the time, subsequently impregnating her.
Sessions Court Judge Jason Juga convicted the 45-year-old accused after finding that the prosecution had successfully proven its case beyond a reasonable doubt after calling eight witnesses.
According to the amended charge, the accused was found raping the 12-year-old victim at their house in Batu Kawa, between June 1, 2019 until June 30. The victim then became pregnant because of the acts.
He was charged under Section 376(3) of the Penal Code, which carries an imprisonment term of between eight and 30 years and with a minimum whipping of 10 strokes.
The accused is a widower and taking care of two of his daughters, aged between nine and 12-years-old.
Both of his daughters are currently under the care of the Welfare Department.
