Cancer-stricken youth pleads guilty to raping underage girl

KUCHING, Jan 31: A man with stage 4 leukaemia today pleaded guilty to raping a 13-year-old girl.

But since the accused is below the age of 21, the court has to listen to his probation report before passing sentence.

Sessions Court judge Marutin Pagan fixed March 5, 2019, for the Welfare Department officer to tender the accused’s probation report and, thereafter, pass sentence on him.

The accused was 19-years-old when he allegedly raped the underage girl at about 9.30pm on June 2, 2018, at a gazebo at Wisma Bapa Malaysia’s recreation park.

He is charged under Paragraph 376(2)(d) of the Penal Code and the offence is punishable under Subsection 376(2) of the same Code, which carries imprisonment of not less than 10 years and not more than 30 years and whipping upon conviction.

According to the facts of the case, the accused and the complainant had just met about a week before the incident, and they had been out for dates three times.

On the night when the incident happened, they were both talking at the scene, and the accused started to hug and kiss the victim. The accused then asked the victim to lie down on the floor, but the victim refused.
