KUCHING, Feb 2: The Sessions Court here sentenced a man to 17 years’ imprisonment and 10 strokes of the cane for committing incest rape on his underage stepdaughter.
Judge Jason Juga meted out the sentence on the 36-year-old kitchen helper after hearing a full trial of the case.
The prosecution had called eight witnesses to testify in court while the defence had called three witnesses.
The accused, through his counsel Francis Teron Kadap wished to appeal against the sentence and thus applied for the stay of execution of imprisonment and whipping.
The stay of execution was granted on the terms that the accused is released on RM20,000 cash bail with two local sureties and is to report to the nearest police station on a weekly basis.
The accused was charged under Section 376B of the Penal Code, for committing incest on his stepdaughter who was 10-years-old at the time, at their house in Kampung Tanjung Bako, at about 12am, on October 1, 2018.
According to the police report lodged by the victim, the victim was sleeping in the living room and the accused came over to her, took off his pants and raped her.
The victim said that was not the first time the accused raped her. She was afraid of her stepfather.
The victim also said the accused threatened her not to tell anyone about his act, and thus the victim did not dare to fight back.
