2 youths sentenced to 4 years’ jail for culpable homicide in Batu Kawah murder case

KUCHING, Nov 10: Two young men, aged 22 and 25, have each been sentenced to four years in jail by the Magistrate’s Court in connection with a murder case in Batu Kawah for culpable homicide not amounting to murder.

Ashley Austin Chin, 25, and Albert Chin Quan Yan, 22, pleaded guilty before Magistrate Zubaidah Sharkawi.

Magistrate Zubaidah convicted both of them under Section 304(b) of the Penal Code, read together with Section 34 of the Penal Code, and sentenced each of them to four years in jail.


The accused, along with four other youth offenders and two individuals still at large, committed the offense at the staircase of a hotel between 12:30am and 1am on Oct 30.

The victim, aged 51 and employed at a hotel near Batu Kawah, was assaulted by a group of men outside the hotel around 12:30 am on Oct 30.

The brutal attack resulted in severe injuries, including a fatal brain injury.

The victim was rushed to Sarawak General Hospital, fell into a coma after the incident, and tragically succumbed to his injuries on Nov 1.

Police investigations revealed that on the day of the incident, Ashley called his friend, who was at a nearby pub, to go to a hotel and look for his wife.

A misunderstanding occurred between them, leading to the assault on the deceased by Ashley and his friends.

Forensic examination showed that the victim passed away due to blunt force trauma to his head.

Meanwhile, the other four youth offenders and two child offenders in the case, aged between 15 and 18, also pleaded guilty to the charge under Section 304(b) of the Penal Code, read together with Section 34 of the Penal Code.

Zubaidah set the case for further mention on Dec 7 to hear their social and probation reports.

The case was prosecuted by Insp Nur Shafiqa Nyaie Ilin, while all the offenders were unrepresented by legal counsel. — DayakDaily
