Youth with stage four leukemia sentenced to Henry Gurney School stay for rape

KUCHING, March 5: A youth with stage four leukemia pleaded guilty to raping a 13-year-old girl and was sentenced to be sent to Henry Gurney School until he reached the age of 21.

The accused pleaded guilty on January 31. But since he had yet to reach to age of 21, the court had to listen to his probation report before passing sentence.


Sessions Court judge Marutin Pagan passed the sentence here today after listening to the accused’s social report from a Welfare Department officer.

The accused was aged 19 at the time of the incident.

He was charged with raping a 13-year-old girl at about 9.30pm, on June 2, 2018 at a gazebo at Wisma Bapa Malaysia Recreation Park.

He is charged under paragraph 376(2)(d) of the Penal Code and punishable under subsection 376(2) of the same code, which carries a imprisonment term of not less than ten years and not more than thirty years, and whipping.

According to the facts of the case, the accused and the complainant had just met about a week before the incident and they had dated three times.

On the night when the incident happened, they were both talking at the scene, and the accused started to hug and kiss the victim. The accused then asked the victim to lie down on the floor but the victim refused.
