Trial of teacher charged with non-physical sexual assaults of 2 students with disabilities postponed

KUCHING, March 4: The trial of a teacher of a special education school who has been accused of making two male students with disabilities commit anal intercourse and producing child pornography of the same students has been postponed to May this year.

The trial was supposed to start today before Sessions Court Judge Mohd Taufik Mohd Yusoff but it was postponed to May 6-7 as the Deputy Public Prosecutor had some urgent matters to attend to.


Accused Mohamad Musa Eden is represented by Francis Teron Kadap, while the DPP is Nor Azhari Yusof.

Mohamad Musa is slapped with a total of four charges, and the alleged crimes were all committed at the same place, same date and at the same time.

For the first charge, under paragraph 15(a)(ii) of the Sexual Offences Against Children Act 2017 and punishable under Section 15 of the same Act to be read together with Section 16, he is alleged to have asked both male victims to show their body parts to him at the special education school’s PAV Room on July 7, 2017, at about 12.30pm.

For the second charge, under Subsection 14(b) of the Sexual Offences Against Children Act 2017 and punishable under Section 14 to be read together with Section 16 of the same Act, Mohamad Musa is alleged to have made the two same victims commit anal intercourse.

As for the third charge, under Subsection 15(f) of the Sexual Offences Against Children Act 2017 and punishable under Section 15 to be read together with Section 16 of the same Act, he is alleged to have made one of the victims to engage in a sexual activity.

For the fourth charge, under Section 5 of the Sexual Offences Against Children Act 2017 to be read together with Section 16 of the same Act, he is alleged to have made child pornography of the said victims.

Section 5 of the Act provides for an imprisonment term of not more than 30 years plus whipping of not less than 6 strokes.

Section 15 of the Act provides for an imprisonment term of not more than 10 years or fine not exceeding RM20,000 or both.

Section 16 of the Act provides for an imprisonment term of not more than 5 years and whipping of not less than 2 strokes. — DayakDaily
