Three men discharged and acquitted over drug possession charge

KUCHING, March 1: The Sessions Court here acquitted three men who were charged with possession of methamphetamine.

Anderson Alfred Ronson, Joseph Nicholas William and Ignatius Janar were charged under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 39A(2) of the same Act to be read together with Section 34 of the Penal Code.

The prosecution had called six witnesses.

However, Judge Dayang Ellyn Narisa Abang Ahmad ruled that the prosecution had failed to prove a prima facie case with regards to the ingredient of possession of the offence as charged.

The prosecution had also failed to refer the exhibits for DNA swabbing, fingerprints and nail clippings analysis to establish control, custody and knowledge of the drugs and possession by others.

Therefore, the Sessions Court discharged and acquitted all three accused.

The accused were charged with possessing 32.17 grams of Methamphetamine at a room in RPR Taman Sri Cahaya, Batu Kawa Tondong, at about 5.30pm on June 21, 2020.

The prosecution is represented by DPP Ruthra Raj whereas the accused were defended by Major HJ Osman Ibrahim and Nursyaheeqa Nazwa Radzali. — DayakDaily
