Teacher gets 22 years’ jail, 4 rotan strokes for raping student in Siburan

KUCHING, May 3: Mathematics teacher Muhaini Bojeng, 53, was today sentenced to a total of 22 years imprisonment and four strokes of the rotan for raping an underage student in 2017.

The accused, from Kampung Tebakang Melayu, Serian, was slapped with two charges.


For the first charge, Sessions Court judge Dayang Ellyn Narisa Abang Ahmad sentenced him to 10 years’ jail and two rotan strokes. For the second charge, he was sentenced to 12 years’ jail and to be whipped twice.

Dayang Ellyn ordered the imprisonment sentences to run consecutively.

Immediately after the sentence was meted out, Muhaini’s counsel, Sylvester Wit Malang, applied for a stay of execution pending an appeal application. Sylvester told the court that his client suffered chronic coughing, diabetes and high blood pressure, which needed full attention, but he failed to prove these with a medical certificate.

Hence, Dayang Ellyn dismissed his application for a stay of execution.

According to the charge sheet, Muhaini allegedly raped his 14-year-old student in August between 12.30pm and 2pm and again on Sept 14 at between 11.40am and 4pm at two different parking lots in Siburan.

Both offences come under Paragraph 376(2)(d) of the Penal Code and Subsection 376(1) of the same Code. Paragraph 376(2)(d) carries imprisonment of not less than 10 years and not more than 30 years and shall be liable to whipping if convicted. Subsection 376(1) provides an imprisonment term that may extend to 20 years and shall be liable to whipping, upon conviction. — DayakDaily
