Security guard fined RM1,800 for punching man in the eye

KUCHING, Sept 20: The Magistrate’s Court here sentenced a security guard to a fine of RM1,800 to a charge of punching a supervisor of a factory because of a misunderstanding.

Derrick Crossfield Francis Kanan, 26, pleaded guilty to the charge framed under Section 323 of the Penal Code before Magistrate Syarifah Fatimah Azura Wan Ali.


Section 323 of the Penal Code carries a maximum imprisonment term of one year or a fine of up to RM2,000 or both upon conviction.

Magistrate Syarifah Fatimah convicted Derrick as charged and sentenced him to a fine of RM1,800 or in default to two months imprisonment.

Derrick allegedly voluntarily caused hurt to a 33-year-old man at the loading bay of a shopping mall in Jalan Song, at about 4pm on Sept 5.

According to the brief facts of the case, the victim parked his car at the loading bay of the mall as he was sending fruits to the supermarket there.

After he had conducted his business and went back to his car, he found that one of his car tires was clamped. He then went to the security guard room to ask for the clamp to be removed.

The victim was then asked to pay a fine of RM200 for the security guard to remove the clamp as the area was meant for vans and lorries.

The victim was unsatisfied and bought some tools to cut the said clamp off.

The accused suddenly appeared and punched the left eye of the victim, who then had to undergo treatment at a hospital where his injury was stitched up.

Prosecuting Officer Inspector Mohd Adzmei Ahmad prosecuted while the accused was unrepresented by counsel. — DayakDaily
