School principal claims trial to CBT and misappropriation of Special Needs Student Allowance

KUCHING, July 9: A school principal claimed trial to criminal breach of trust (CBT) and misappropriation of Special Needs Student Allowance (EMK) in the Sessions Court here today.

Madahan Busman, 49, pleaded not guilty to the main charge and alternative charge framed.

Sessions Court Judge Steve Ritikos allowed the accused to be released on a court bail of RM10,000 with two local sureties.


Ritikos also fixed July 23 for pre-trial case management with the trial of the case to be heard from Sept 22 to 28 this year

For the main charge, the accused as the principal of Sekolah Kebangsaan (SK) Beradek in Padawan had been entrusted with cash money of RM4,500 that had been allocated for the EMK but he allegedly failed to distribute the said money to the students, between Jan 2019 to Dec 2019.

He was charged under Section 409 of the Penal Code for the main charge, which carries an imprisonment of between two years and twenty years and with whipping and liable to fine, upon conviction.

For the alternative charge, he was alleged to have dishonestly misappropriated the cash money of RM4,500 that was allocated for EMK, between Jan 2019 to Dec 2019.

He was charged under Section 403 of the Penal Code for this offence, which carries an imprisonment between six months and five years and with whipping and liable to fine, upon conviction.
