Man sentenced to 15 months jail for trespassing, assault

KUCHING, Aug 9: The Magistrate’s Court today sentenced a 46-year-old man to one year and three months in prison after he pleaded guilty to charges of trespassing into a rental home and injuring its tenant.

Alphian Abdullah, faced two charges before Magistrate Syarifah Fatimah Azura Wan Ali under Section 447 and Section 324 of the Penal Code.

The court ordered Alphian to serve a one-year prison sentence, effective immediately, for the first charge of injuring a 47-year-old male victim with a knife.

The offense occurred on Aug 4, at around 10.30pm, on a street in front of a hotel on Jalan Datuk Ajibah Abol, Kampung Masjid.

For the second charge of trespassing into the victim’s rental home in Kampung Masjid, during the same incident, the court sentenced Alphian to an additional three months in prison, starting from the date of his arrest on Aug 5.

Case details revealed that the victim was resting in his room when he heard a housemate shouting that a burglar had entered the premises.

The victim left his room and saw two men fleeing the scene. He chased after them and managed to catch Alphian on the street in front of the hotel.

A struggle ensued, during which Alphian used a knife, inflicting injuries on the victim’s abdomen, back, cheek, and even splitting the victim’s left ear lobe in two.

The victim was later taken to the emergency ward at Sarawak General Hospital for treatment, and a police report was subsequently filed.

Alphian was arrested the following day, on Aug 5.

Investigations revealed that the assault was witnessed by a security guard stationed at a guard post opposite the victim’s rental home.
