Man pleads guilty to attempting to rape, threatening to kill niece

KUCHING, Aug 18: A jobless man pleaded guilty to charges of attempting to rape and threatening to kill his niece.

Sessions Court Judge Steve Ritikos accepted Mohd Idris Abot’s guilty plea to both charges and sentenced him to imprisonment of five years and six strokes of the cane for the first charge and 30 months’ imprisonment for the second charge.

The judge ordered the imprisonment terms to run concurrently and to run from the date of his arrest, Aug 4, 2019.

The accused, 27, was charged with attempting to rape his niece at the victim’s house at about 3am on Aug 3, 2019.

He was charged under Section 376 of the Penal Code, read together with Section 511 of the same Code.

Section 376 of the Penal Code carries a maximum imprisonment term of 20 years and whipping, upon conviction. Section 511 of the Penal Code carries an imprisonment term not exceeding one-half of the longest term provided for the offence.

For the second charge, the accused was charged with criminal intimidation for putting a knife to his niece’s neck and threatening to kill her, at the victim’s house, at about 3am on Aug 3, 2019.

He was charged under Section 506 of the Penal Code, which carries an imprisonment term of up to seven years, or with fine or with both, upon conviction.
