KUCHING, Aug 14: An unemployed 22-year-old man was sentenced to one year in prison by the Magistrate’s Court here today for threatening to harm his father in a violent incident last June.
Hafarizan Johari pleaded guilty to the charge under Section 506 of the Penal Code before Magistrate Mason Jaro Lenya Barayang.
The accused was charged with making the threats against his 59-year-old biological father at their home in Bako, around 3pm on June 26. He faced up to 2 years’ imprisonment, or a fine, or both, if found guilty.
Based on the facts of the case, during the incident, the accused who is the complainant’s youngest son suddenly flew into a fit of rage, uttering profanities and criminal threats towards the complainant, even challenging him to a physical confrontation.
The accused was also reported to have armed himself with a kerambit, likely in an attempt to provoke a fight after his father declined his challenge.
Frustrated by his inability to provoke a fight, the accused proceeded to hurl a stone at a window, causing damage, and slammed the front door with such force that it was significantly damaged.
The estimated loss suffered by the complainant was around RM250.
Concerned for their own safety as well as that of other family members, the complainant lodged a police report, which led to the defendant’s arrest on July 1.
Subsequent investigations revealed that the accused had a history of violent outbursts that instilled fear in his family members.
Furthermore, the complainant stated that his son had been involved in drug related activities and had reported this to the National Anti-Drug Agency.
The prosecution of the case was led by Inspector Merylene Lindan Andrew Mang, while the accused did not have legal representation.
In an earlier court hearing, on July 4, the accused was sentenced to one year in prison by the Magistrate’s Court after admitting guilt to a charge under Section 427 of the Penal Code for intentionally damaging property during the same incident. — DayakDaily
