Man jailed 134 months, girlfriend fined RM125k over stolen properties

KUCHING, Nov 20: An unemployed man was sentenced to a total imprisonment of 134 months, while his girlfriend was sentenced to a total fine of RM125,000 for retaining and disposing of stolen properties.

Shahrizan Subil Billah, 25, pleaded guilty to nine charges, while Siti Nursya’amah Abdullah, 30, pleaded guilty to three charges, at two separate Magistrate’s Court here today.


The male accused was charged with three charges under Section 414 of the Penal Code, where he was found to have assisted in dumping two gold necklaces, one gold bracelet and one gold bar, at Yoshi Square, KFC & Pizza Hut headquarters, Jalan Tabuan, and Sugarbun Pending between Oct 31 and Nov 5.

Magistrate Nuruhuda Mohd Yusof sentenced him to imprisonment of 10 months for each charge, but instructed the jail term to run concurrently.

Shahrizan and Siti Nursya’amah were jointly charged for dishonestly retaining a jade locket and three gold necklaces belonging to Lim Swee Chung, at an unnumbered house in Lorong Sungai Apong Baru 1E1, at about 4 pm on Nov 15, 2019.

They were charged under Section 411 of the Penal Code and to be read together with Section 34 of the same Act, which carries imprisonment term up to five years or with fine, upon conviction.

Judge Nuruhuda sentenced Shahrizan to an imprisonment term of 12 months, which would run consecutively with the other jail sentences.

Shahrizan also faced three charges under Section 414 of the Penal Code for voluntarily assisting in disposing stolen properties, such as 100 grammes of gold bar, two gold necklaces, three gold bracelets, one gold ring, gold locket and one gold pendant, at Mile 3 CIMB Bank and Yoshi Square respectively, between Oct 22 and Oct 27.

Senior Assistant Registrar Nuraini Ahmad sentenced him to imprisonment of 24 months for each charge, and ordered the imprisonment term under this case to be run concurrently and consecutively with the two other imprisonment terms.

Shahrizan was also found guilty of two charges, where he was found to dishonestly retained stolen properties consisting seven gold bracelets and a gold bar belonging to Lim, at a house in RPR Matang, between Nov 7 and Nov 15.

He was charged under Section 411 of the Penal Code under this case and was sentenced to an imprisonment of ten months.

Nuraini ordered the imprisonment term under this charge to be run concurrently and consecutively with the three imprisonment terms above.

Siti Nursya’amah was found to voluntarily assisting in disposing of stolen property, which is a gold ring on Oct 5. She was charged under Section 414 of the Penal Code and was sentenced to a fine of RM5,000 in default to six months’ imprisonment.

She was also found to dishonestly retaining stolen properties, a gold necklace and a bangle on Nov 7. She was charged under Section 411 and was sentenced to a fine of RM4,000 in default to six months’ imprisonment.

According to the facts of the case, the complainant, Lim, discovered the loss when he arrived at the scene with his wife and son.

They found out that their shop had been broken into, through the second-floor roof. They discovered the missing gold accessories in the safety box estimated to cost around RM500,000 and cash around RM20,000.

DPP Muhammad Hafiz Musa prosecuted while both accused were unrepresented. — DayakDaily
