SIBU, April 29: A man who sexually assaulted an underaged girl was sentenced to a jail term of five years and five strokes of the cane by the Sessions Court today.
The accused, Gimang Agu, pleaded guilty before Judge Marutin Pagan.
Gimang, 31, was charged under Section 14 (a) of the Sexual Offence against Children Act 2017. The offence provides for an imprisonment of not exceeding 20 years and whipping.
According to the brief facts of the case, the victim, aged 11 years and 3 months and a person with disabilities was on April 23 inside a toilet of a cargo company when the accused showed up.
He removed her pants, hugged her and touched her private parts. After that he tried to rape her but could not do so as he heard someone coming.
When he ran out of the toilet, the victim’s uncle who happened to be nearby, quickly stopped him.
The girl’s father then went to the toilet as he felt something was amiss as she was there for too long.
When he opened the toilet door, she was in a state of undress and subsequently told him that she had been raped by an unknown person in the toilet. — DayakDaily
