Man gets 17 years’ jail, 7 strokes for raping disabled stepdaughter

KUCHING, Nov 29: A man was today sentenced to 17 years in jail and seven strokes of the rotan by the Sessions Court for committing incest on his underaged and disabled stepdaughter.

Phang Lin Kong, 48, from Kampung Gerunggang in Lundu, pleaded guilty to the charge. In his mitigation, he appealed for a lenient sentence by saying it was his first offence, he has two children and is the sole breadwinner of the family. He also claimed he was remorseful for his actions.


But in view of the seriousness of the case, Sessions Court judge Jason Juga sentenced him to 17 years imprisonment and seven strokes of the cane.

Phang was charged under Section 376B of the Penal Code for committing incest on his underaged and disabled 13-year-old stepdaughter on Nov 15 this year at about 7am at an unnumbered house in Kampung Gerunggang, Lundu.

According to the brief facts of the case, the victim was in her bedroom when the accused went into her room and asked her to take off her pants. Initially, she refused to do so, but as she was too afraid of the accused, she eventually did what she was told. The accused then raped her.
