KUCHING, Nov 12: An unemployed man was fined RM3,200 and ordered to undergo supervision for two years for dangerous drugs consumption by the Magistrate’s Court here today.
However, he claimed trial to dangerous drugs possession before Magistrate Zubaidah Sharkawi.
For the first charge, Mohd Iswandy Hasani, 33, from Kampung Kudei Baru, was found to have in possession of 29.18 grammes of Methamphetamine in front of Pleasant Court Apartment Block, Jalan Stampin Timur, at about 4pm on Sept 5.
He was charged under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 39A(1) of the same Act, which carries imprisonment term between two years and five years and liable to whipping between three strokes and nine strokes, upon conviction.
He pleaded not guilty to this charge. The court fixed Dec 13 for pre-trial case management.
For the second charge, he was found to administer Amphetamine and Methamphetamine at Sarawak Contingent Narcotics Crime Investigation Department office, at about 4.40pm on Sept 5, 2019.
He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 15(1) of the same Act, which carries imprisonment term not exceeding two years and undergoes supervision for a period between two years and three years.
He was sentenced to a fine of RM3,200 in default to three months imprisonment and undergo supervision for two years after he pleaded guilty to the charge (self-administration of dangerous drugs).
Prosecuting Officer Rogayah Rosli prosecuted, while the accused is unrepresented. — DayakDaily
