KUCHING, July 19: An unemployed man has been acquitted and discharged by the Sessions Court here for three counts of raping a 15-year-old girl two years ago.
Judge Marutin Pagan ordered the accused to be freed after finding that the prosecution had failed to establish a prima facie in the case.
The accused was alleged to have committed rape on a girl on Dec 27, 2016, between 8pm and 11pm; January 2017, between 8.20pm and 11pm; and Dec 17, 2017, between 8.15pm and 10pm, at his room at KMC Flat.
The victim was 15 years old in 2016.
He was charged under Section 376(1) of the Penal Code, which carries a maximum 20 years imprisonment and whipping upon conviction.
