Lorry driver gets one year’s jail, one stroke of cane and fined RM1k for CBT

KUCHING, April 30: The Sessions Court here sentenced a lorry driver to a jail term of one year, one stroke of the cane and a fine of RM1,000 for criminal breach of trust amounting to RM 1,008.70.

Mohammad Hanafiah Omar, 46, pleaded guilty to the charge framed under Section 408 of the Penal Code, which carries an imprisonment term of between one year and fourteen years and with whipping and liable to fine.


Sessions Court Judge Jason Juga accepted his guilty plea and sentenced him to a one-year jail term, one stroke of the cane and a fine of RM1,000 or in default of one month’s imprisonment.

The accused, a lorry driver attached to a company in Jalan Demak Laut here, was found to have committed criminal breach of trust in respect of cash money amounting to RM1,008.70 belonging to the said company, on Dec 3, 2020.

According to the brief facts of the case, on Dec 3 last year, the accused was on duty to send the goods by cash on delivery to six buyers. The total amount of cash collected was RM1008.70. The money was supposed to be handed over to the company on Dec 4 in the morning but the accused did not turn up and was unreachable by telephone.

Deputy Public Prosecutor Nurfadzlin Mahmad Zulhasnan prosecuted while the accused was unrepresented by counsel. — DayakDaily
