Labourer sentenced to 8 years’ jail, three cane strokes for hurting woman with knife during sexual assault

KAPIT, June 22: The Sessions Court here yesterday sentenced a labourer to eight years’ jail and three strokes of the rotan for hurting a woman with a knife.

The accused, Daniel Sugai, 22, of Rumah Sugai, Sungai Song, pleaded guilty to the charge under Section 326 of the Penal Code.

According to the brief facts of the case, he had trespassed into the victim’s quarters at SK Nanga Selibut, Song at about 2.15pm on May 27.


After relieving himself in the toilet, he went to the bedroom and saw the victim, 30, sleeping.

He then took a knife from the kitchen and lay next to the woman. When he started to molest her, she screamed for help, which caused him to attack her with the knife.

At about 2.30pm, the victim’s husband found her unconscious and rushed her to Song Health Clinic and later Sibu Hospital.

The victim was in grievous pain for 10 days due to bodily injury.

The accused was arrested at about 7.30pm on the same day at the school after the victim’s husband lodged a police report.

The accused is also facing two more charges under Section 422 and 354 of the Penal Code.

Subordinate Court Sibu assistant registrar Romme Ahmad Zaidi had on June 8 released the accused on RM3,000 bail each for these first two charges.

He also ordered the accused to appear at Kapit Magistrate’s Court on June 27 for hearing of the cases.

In the first charge under Section 442 of the Penal Code, Daniel was accused of trespassing into the victim’s quarters.

The Section provides for a jail term of up to three years or fine of up to RM5,000 or both if convicted.

In the second charge, he was accused of outraging the modesty of the woman at the same time and place.

He could be jailed for up to 10 years or fined, or be subjected to whipping. — DayakDaily
